Procedure to be followed if dissatisfied with operation of irrigation system
6 February 2002
The completion of a "Commissioning Certificate" during the initial operation of an irrigation system ought to be standard procedure. The producer and system designer should each keep a copy for future reference. Examples of documents to be used appear in the System Evaluation Manual of the ARC-IAE as endorsed by SABI.
If a system cannot satisfactorily be set to work or does not perform properly the producer must inform the designer / company in writing of the problem experienced within a reasonable time (12 months) after installation. The designer / company must investigate within or not later than one month after receipt of the letter and suggest in writing and implement the necessary solutions.
If still dissatisfied with the operation of the system, the producer or a representative may place a written request with SABI for an independent investigation. SABI must notify the designer / company in writing of the complaint to provide the opportunity for reaction.
It is recommended that the producer does not launch legal proceedings before considering the reaction of the particular designer/company.
SABI will facilitate an independent investigation if the designer/company does not react favorably or the producer remains dissatisfied with the operation of the system.
SABI will approach qualified system-investigators for a quote to investigate the design, installation, operation and performance of the system. The investigation will be done according to the SABI norms- guidelines for system design and evaluation. The investigator should be acceptable to both parties (producer and designer / company).
Investigation costs are usually for the producer's account, unless the design was done by an approved SABI designer-member, where the costs will be covered by SABI. The investigation report is to be sent to SABI.
After completion of the investigation, SABI will forward the results in writing to the producer and the designer / company.
Depending on the findings of the system investigation, the designer/company must, within one month of receipt of written notification, commence with the necessary alterations to the system and complete work within a reasonable period. If thereafter, the producer is still dissatisfied with the performance of the system, he may launch legal proceedings.
Any witnessing or other services to be delivered by the system investigator or other SABI members/experts in court cases will be charged to the producer.
